    Acceptable Use Policy

    Welcome to  Simply Send , an email delivery service provided by Simply Invent Labs LLC ("we," "us," or "our"). This Acceptable Use Policy ("AUP") outlines the terms under which you may access and use the  Simply Send  email delivery service (the "Service"). By using the Service, you agree to comply with this AUP. We reserve the right to modify this AUP at any time.

     Simply Send  supports both transactional emails (triggered by user actions within your own product or service) and marketing emails (sent to recipients of your own brand). Cold emails, unsolicited outreach, and sending on behalf of third-party brands you do not own are strictly prohibited and will result in immediate account suspension.

    1. Email Sending Requirements

    To maintain high deliverability and protect our sending reputation, all email sending through  Simply Send  must meet the following requirements:

    Sending Rules:
    • Marketing emails must only be sent to recipients who have signed up to receive marketing communications from your brand. Cold emails and outreach to people who have not consented are strictly prohibited.
    • Transactional emails must be directly related to a user action within your own product or service (e.g. password resets, order confirmations, account notifications). They must not be used for promotional purposes.
    • Cold emails and unsolicited outreach are strictly prohibited, regardless of email type.
    • Sending on behalf of third-party brands or businesses you do not own or have explicit written authorisation to represent is strictly prohibited.

    1.1 Sending Statistics

    Your account must maintain the following metrics:

    • Complaint Rate: Must be lower than 0.08%
    • Bounce Rate: Must be lower than 4%
    • Spam Trap Hits: Zero tolerance policy
    Accounts exceeding these thresholds may be subject to temporary suspension or termination without prior notice.

    1.2 Mailing List Requirements

    All email recipients must have provided explicit consent to receive communications from you. When sending to contacts, you must:

    • Obtain consent through a clear opt-in process
    • Include a valid physical mailing address in all emails
    • Clearly identify yourself or your organization
    • Provide a prominent and functional unsubscribe mechanism
    • Process opt-out requests within 7 days
    • Never use purchased, rented, scraped, or third-party email lists

    2. Prohibited Content

    The following types of content are strictly prohibited in emails sent through our Service:

    • Cold emails, unsolicited outreach, or emails sent to recipients who have not explicitly opted in
    • Marketing emails sent using the transactional API
    • Emails sent on behalf of third-party brands or businesses you do not own or are not explicitly authorised to represent
    • Bulk email campaigns to purchased, rented, or scraped lists
    • Adult content, pornography, or sexually explicit material
    • Illegal goods or services
    • Pharmaceutical products or supplements with unverified claims
    • Gambling, betting, or casino-related content
    • Multi-level marketing or pyramid schemes
    • Get rich quick schemes or high-yield investment programs
    • Payday loans, short-term financing, or debt collection services
    • Counterfeit or replica products
    • Malware, viruses, or any malicious software
    • Content that promotes violence, hate, or discrimination
    • Misleading or deceptive content
    • Harassment, threats, or abusive content

    3. Prohibited Activities

    When using the Service, you agree not to:

    • Send cold emails, spam, or unsolicited bulk email of any kind
    • Use purchased, rented, scraped, or third-party email lists
    • Send emails on behalf of any brand, product, or service you do not own or have written authorisation to represent
    • Use the marketing API for transactional emails or the transactional API for promotional content
    • Manipulate or forge email headers
    • Impersonate others or misrepresent your identity
    • Engage in phishing or social engineering
    • Interfere with or disrupt the Service
    • Attempt to gain unauthorized access to our systems
    • Use the Service to violate any laws or regulations
    • Circumvent any security measures or rate limits
    • Use the Service to send emails to harvested email addresses

    4. Account Usage

    4.1 General Restrictions

    You are prohibited from:

    • Creating multiple accounts to circumvent usage limits
    • Sharing API keys or account credentials
    • Using the Service to send emails on behalf of third parties without authorization
    • Engaging in any activity that could harm our infrastructure or reputation

    4.2 Compliance with Laws

    You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations, including but not limited to:

    • CAN-SPAM Act (US)
    • CASL (Canada)
    • GDPR (EU/UK)
    • ePrivacy Directive
    • Other applicable data protection and privacy laws

    5. Monitoring and Enforcement

    We reserve the right to:

    • Monitor your use of the Service for compliance with this AUP
    • Investigate any suspected violations
    • Remove or disable access to any content that violates this AUP
    • Suspend or terminate your account for any violation of this AUP

    We will make reasonable efforts to notify you of any violations and provide an opportunity to cure when appropriate. However, we may take immediate action without notice in cases of severe violations or threats to our infrastructure.

    6. Reporting Violations

    If you believe that another user of the Service is violating this AUP, please report it to us immediately at support@simplyinventlabs.com. Include as much detail as possible, including message headers and a description of the violation.

    7. Changes to This Policy

    We may update this Acceptable Use Policy from time to time. We will notify you of any changes by posting the new policy on this page and updating the "Last updated" date at the top of this document. Your continued use of the Service after such changes constitutes your acceptance of the revised policy.
